Terms and conditions of snow sports equipment rental by SkiHigher Samoens (SARL JoBeck, Chalet Helina, Le Bouchet Verchaix, SIRET 80457529800026) via online bookings
The rental contract is made between the customer making the reservation (henceforth known as the Client) and the respective sports company, (henceforth known as SkiHigher Samoens) from which the equipment is rented.
According to the law n° 78-17 dated 6th January 1978 on IT, computer files and liberties, the Client is granted a right to access and modify any registered information held regarding them self, which we shall supply upon request in writing.
The Client, wishing to rent materiel from this website must first identify him or herself to become a client i.e. they must fill in an online form, where they will supply their surname, first name, rental address and other relevant information.
The rental of the snow sports equipment, as summarised on the internet site, will only be validated if the Client agrees to the conditions described herein by showing their acceptance of the Terms and Conditions on the booking form.
1. Booking and Prices
The booking is validated for the Client when the booking form is completed and the booking confirmation is received.
Rental prices depend on the category of materiel rented by the Client from the categories defined on skihighersamoens.com/equipment
SkiHigher Samoens reserves the right to modify these categories and applicable tariffs over the course of the season, however, prices on booking confirmations will prevail.
Any discount or promotional code needs to be entered at the confirmation stage of the booking process.
Only one promotional code or discount can be used per booking. No refund will be given for a wrongly entered or forgotten promotional/discount code.
All promotional codes whether published online or via newsletter, are valid for a predetermined duration.
The Client may be required to provide credit card details during the booking process to cover any loss, theft or damage of equipment which will be stored for 7 days after the rental period has lapsed. See article 3.
SkiHigher Samoens reserves the right to refuse any reservation.
2. Payment
In accepting the Terms and Conditions, the Client agrees to pay the full amount shown on the invoice presented by SkiHigher Samoens on delivery of equipment.
Payment can be made with a credit card (CB, visa, eurocard or master card) which is recognised by the international network, GIE Cardbank) or in cash at the end of the rental period.
3. Insurance
Snow sports equipment insurance is priced at €2 per day per adult and €1 per day per child (up to 16 years old) and is added to the booking during the “Equipment” stage of the booking process.
Insurance provided by SkiHigher Samoens covers only the theft, loss or damage beyond repair of rental items.
No excess amount applies.
Should the Client choose not to add insurance to the booking, they will be required to provide credit card details during the booking process to cover any loss, theft or damage of equipment which will be stored for 7 days after the rental period has lapsed.
Any excessive damage, deemed to be negligent, will imply payment by the Client of replacement or repair costs. The maximum limit of the replacement / repair cost will be the cost of replacing the ‘as new’ equipment. This cost will be in addition to the rental costs already paid.
Insurance cannot be added after the delivery of equipment.
4. Cancellation or Withdrawal
If the Client finds they are unable to be present on the first day of hire which they have confirmed, the Client must inform SkiHigher Samoens in the shortest possible time by sending a message using the address info@skihighersamoens.com
In the event of lack of snow or personal injury, the invoice will be amended only in the instance that the equipment is returned. Any days the equipment is unused but not returned to SkiHigher Samoens will not be credited.
5. Delivery and use of hired material
Delivery will be agreed between the Client and SkiHigher Samoens on the day of delivery by text or phone.
The Client understands and agrees that neither the SkiHigher Samoens staffs hiring the equipment, SkiHigher Samoens, nor their affiliate or subsidiary corporations, nor any of their respective employees, officers, agents or assigns accept any responsibility for any death, injury or other loss suffered by the Client to the extent that it results from their own conduct or any matter or condition under their control that amounts to their own contributory negligence. In the absence of any negligence or other breach of duty by the ski professionals, SkiHigher Samoens and all parties referred to above, the Clients’ participation is entirely at their own risk. The Client acknowledges having read this Statement and have read all of the terms and conditions before hiring any equipment.
The equipment will be set up using international standard DIN settings based on the information provided by the client at the time of booking – it is the Clients’ responsibility to ensure this information is correct.
The Client becomes fully responsible for the rental equipment as soon as it is issued to him. The Client alone shall be the sole judge of whether he is capable of using the rental equipment and takes full responsibility for minors in the party under the age of 18.
Exchanging the equipment, within the pre-booked category, is once free of charge. If equipment of a higher category is taken in replacement, a surcharge is payable, in accordance with the price list. No refund will be given in the case of replacement equipment from a lower category.
Overnight, sport equipment should be stored in a locked ski room at the accommodation or in a locked vehicle.
6. Return of hired equipment
Equipment returns must be arranged with SkiHigher Samoens staff by 18:00 on the last day of use. Failure to arrange collection before this time will incur a charge equivalent to one day’s rental on all equipment on the booking.
7. Applicable laws and jurisdiction
In case of discrepancies between the French version and the English version of this Agreement, the provisions of the French version shall prevail.
This agreement is subject exclusively to French law and is under the exclusive jurisdiction of the Courts of France.
Privacy Policy
At SkiHigher Samoens we are dedicated to safeguarding and preserving your privacy when visiting our site or communicating with us. We adhere to the requirements of the EU General Data Protection Regulation (GDPR) and the Data Protection Act 1998.
This Privacy Policy, together with our Terms and Conditions, explains what happens to any personal data that you provide to us, or that we collect from you.

1. How we collect information
We will only collect personal information from you by specifically asking for it:-
•When you write to us, telephone or email us; or complete a form on our website to make an enquiry or other communication.
•When you register with us to receive newsletters or email updates; and when you enter competitions or take part in surveys and customer feedback.

We may collect all or some of the following information relating to you or other members of your holiday party:-
•names, dates of birth and contact details (email address and telephone numbers);
•credit/ debit card or other payment details;
•personal details relating to ski requirements i.e. height, weight, shoe size etc.
•Travel details i.e. flight numbers and arrival times
3. How we use the information you give us
When we make your booking, we must use your information in the following ways:-
We will use the names and personal details of your holiday party to select appropriate ski equipment and calculate DIN settings.
We will use the email address you give us to send you confirmation of booking and with your specific consent, we will use it to contact you with future offers and information about the services we provide.
We will use your phone number and travel information to keep in touch with you on your day of arrival and during your stay.
Your credit/ debit card or other payment details will be used in the occasion of damage, loss or theft of equipment, not to take payment for rental.
If you fail to provide us with this information, we may not be able to plan or confirm your booking.
Where we rely on consent to use your information, you have the right to withdraw that consent at any time. Please refer to the ‘Your Rights’ section of this policy for further details. Please note the implications if you withdraw your consent to us using your information as described.
4. Disclosing Your Information
Where applicable, we may disclose your personal information to any member of our group. This includes, where applicable, our subsidiaries and staff.
5. Storing Your Personal Data
Information is stored by us on secure servers located in the UK.
Details relating to any transactions entered into on our website will be encrypted to ensure its safety.
The transmission of information via the internet is never completely secure and therefore we cannot guarantee the security of data sent to us electronically and transmission of such data is therefore entirely at your own risk.
We also store information in paper files that are stored securely.
We will keep your information for only as long as we need it for or until such time as you instruct us to delete it.
6. We’d like to stay in touch
We will only send you direct marketing in accordance with your marketing preferences. When we collect your name, postal and email address as part of our booking process or when you make an enquiry, we will ask you for your permission to make use of those details for these purposes and if you give us that permission, you can change your mind and ask us not to stay in touch at any time by contacting us via telephone on +33 (0) 6 45 54 96 03 or email at info@skihighersamoens.com. We will never share information about you with third parties for their own marketing purposes. Be aware that if you unsubscribe completely from our marketing communications we may be unable to notify you of tailored offers to meet your needs.
7. Third Party Links
You mind find links to third party websites on our website. These websites should have their own privacy policies which you should check. We do not accept any responsibility or liability for their policies whatsoever as we have no control over them.
8. Use of Cookies
On occasion, we may use third-party cookies and similar technologies to collect or receive information about your computer for our services and to provide statistical information. For more information on how we use cookies please read our Cookie Policy, where you can also find information so you can delete cookies or block certain types of cookie. You should note that this may have an impact on our ability to provide website services to you.
9. Google Analytics and Google AdWords
This website uses Google AdWords remarketing service to advertise on third party websites (including Google) to previous visitors to our site. It could mean that we advertise to previous visitors who haven’t completed a task on our site, for example using the contact form to make an enquiry. This could be in the form of an advertisement on the Google search results page, or a site in the Google Display network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to the Ski Independence website. Of course, any data collected will be used in accordance with our own privacy policy and Google’s privacy policy. You can set preferences for how Google advertises to you using the Google Ad Preferences page, and if you want to you can opt out of interest-based activity entirely through your cookie settings or permanently using a browser plugin.
We may use Google Analytics for the following purposes:-
•Remarketing (showing our ads on third party websites). Ski Independence and third-party vendors, including Google, use cookies to inform, optimise and serve ads based on someone’s past visits to our website.
•Google Display Network Impression Reporting. Ski Independence and third-party vendors, use cookies to report how our ad impressions, other uses of ad services and interactions with these ad impressions and ad services are related to visits to our site.
•Google Analytics Demographics and Interest Reporting. Ski Independence use data from Google’s Interest-based advertising or 3rd-party audience data (such as age, gender and interests) with Google Analytics to inform our marketing strategy.
Visitors can opt out of Google Analytics for Display Advertising and customise Google Display Network ads using Google’s Ad Settings page. Visitors can opt out of Google Analytics using this browser add-on.
10. Your Rights
You always have the right to review the personal information we keep about you. Your rights include:-
•the right in certain circumstances to have inaccurate personal data rectified, blocked, erased or destroyed
